Welcome to The Parking Company ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our smart parking services, mobile application, and website (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

2. Service Description

The Parking Company provides smart parking solutions including:

• Real-time parking availability information
• Cashless payment processing for parking fees
• Digital parking permits and passes
• Parking session management and analytics
• Integration with parking operators and city management systems

3. User Accounts and Registration

To use our Services, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

4. Payment Terms

Our pricing structure includes:

• Pay-per-minute: ₹0.20 per minute of parking
• Daily rates: ₹150 per calendar day
• Enterprise rates: ₹4 per car, ₹2 per bike (for tech-enabled solutions)

Payments are processed through secure third-party payment providers. All fees are inclusive of applicable taxes. You authorize us to charge your selected payment method for all parking fees incurred.

5. User Obligations

When using our Services, you agree to:

• Comply with all applicable local traffic and parking regulations
• Provide accurate vehicle information when starting parking sessions
• Park only in designated areas and authorized time periods
• Pay all parking fees promptly and in full
• Not interfere with parking infrastructure or equipment
• Use the Services only for lawful purposes

6. Prohibited Activities

You are prohibited from:

• Using the Services for any illegal or unauthorized purpose
• Attempting to circumvent payment systems or security measures
• Sharing account credentials with unauthorized parties
• Reverse engineering or tampering with our software or systems
• Creating false parking sessions or providing misleading information
• Interfering with other users' ability to access the Services

7. Service Availability

While we strive to provide continuous service availability, we do not guarantee that our Services will be available at all times. We may suspend or restrict access for maintenance, updates, or other operational reasons. We are not liable for any inconvenience or costs resulting from service interruptions.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our data practices as described in the Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law, The Parking Company shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Services. Our total liability for any claims shall not exceed the amount you paid for the Services in the preceding 12 months.

You agree to indemnify and hold harmless The Parking Company from any claims, damages, or costs arising from your violation of these Terms, your use of the Services, or your violation of any rights of another party.

11. Termination

We may terminate or suspend your access to our Services at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Services will cease immediately.

12. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of our Services will be subject to the exclusive jurisdiction of the courts in Kerala, India.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through our website or mobile application. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
