1. Acceptance of Terms

By accessing and using The Parking Company's services, including our mobile application, website, and parking management platform, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Service Description

The Parking Company provides a digital parking management platform that enables users to:

• Find and book parking spaces
• Make cashless payments for parking
• Manage parking permits and passes
• Access real-time parking availability
• Generate digital receipts and reports

3. User Responsibilities

Users of our services agree to:

• Provide accurate and current information when creating accounts
• Use the service only for lawful purposes
• Comply with all applicable parking regulations and local laws
• Pay all parking fees and charges as required
• Not interfere with the proper functioning of our systems
• Maintain the security of their account credentials

4. Parking Lot Rules and Owner/Driver Responsibilities

Customers and vehicle owners parking in any facility managed or operated by The Parking Company agree to adhere to the following responsibilities and code of conduct:

• Safe Driving: Maintain a maximum speed limit of 10 km/h (or as posted) within the parking lot. Drive cautiously, watch for pedestrians, and follow all directional arrows, traffic signs, and floor markings.
• Proper Parking: Park vehicles fully within the designated lines of a single marked space. Do not block access lanes, driveways, pedestrian walkways, fire exits, fire hydrants, or park in spaces marked for other vehicle types or designated reserving categories.
• Vehicle Security: Before leaving the vehicle, ensure the handbrake/parking brake is firmly engaged, the engine is switched off, all windows are rolled up, and doors are securely locked. Do not leave vehicles unattended with keys inside or engines running.
• Personal Property & Valuables: Remove all personal valuables, bags, devices, and cash from the vehicle. The Parking Company is not responsible for any theft, loss, or damage to valuables or items left inside the vehicle.
• No Custody or Liability for Vehicle Damage/Loss: The Parking Company provides parking space for vehicle convenience and has no custody of or liability for the vehicle itself. Any damage, theft, vandalism, fire, or loss that occurs to the vehicle is the sole responsibility of the vehicle owner or driver. We are providing a space for your cars to park, not custody or safekeeping services.
• Vehicle Condition: Vehicles parked in the lot must be in roadworthy condition and registered. Vehicles must not have active hazardous fluid leaks (e.g., engine oil, fuel, brake fluid). Vehicle owners will be held liable for any environmental cleanup costs or damage to the parking surface caused by their vehicle leaks.
• No Hazardous Materials or Unlawful Activity: Do not store any explosives, flammable fuels (apart from standard vehicle fuel tanks), hazardous chemicals, weapons, or illegal contraband inside the vehicle while in the lot. No tailgating, sleeping in vehicles, or other unauthorized assemblies are permitted.
• No Unauthorized Maintenance: General vehicle servicing, washing, cleaning, engine repairs, or oil changes are strictly prohibited in the parking facility, except for emergency roadside assistance (e.g., changing a flat tire or battery jump-starts).
• Attendant Instructions: Always comply with the lawful instructions and directions given by our parking attendants, security staff, or managers on site.
• Liability for Damage: Vehicle owners/drivers are fully responsible for any physical damage caused to the parking lot infrastructure, barriers, gates, signage, other parked vehicles, or injury to other persons resulting from their vehicle's operation or negligence.

5. Payment Terms

Parking fees are charged according to the rates displayed in the app or at the parking location. Payment is processed through secure third-party payment processors. By using our service, you authorize us to charge your selected payment method for parking fees and any applicable taxes.

All payments are due immediately upon parking session initiation or as otherwise specified. Failure to pay may result in penalties as per local regulations.

6. Refunds and Cancellations

Refunds may be issued at our discretion for technical errors, overcharges, or other exceptional circumstances. Refund requests must be submitted through our support channels within 30 days of the transaction. For detailed refund policy, please refer to our Refund Policy.

7. Privacy and Data Protection

We collect and process personal data in accordance with our Privacy Policy and applicable data protection laws. This includes information necessary to provide our parking services, process payments, and improve our platform.

8. Limitation of Liability

The Parking Company provides the platform "as is" without warranties of any kind. We are not liable for:

• Vehicle damage, theft, or loss while parked
• Parking violations or fines imposed by authorities
• Service interruptions or technical issues
• Indirect, incidental, or consequential damages

Our total liability is limited to the amount of parking fees paid by the user.

9. Intellectual Property

All content, features, and functionality of our services are owned by The Parking Company and are protected by intellectual property laws. Users may not copy, modify, distribute, or reverse engineer any part of our platform without written permission.

10. Termination

We reserve the right to suspend or terminate user accounts for violations of these terms, fraudulent activity, or at our discretion. Users may terminate their accounts by contacting our support team.

11. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of the courts in Kerala, India.

12. Changes to Terms

We reserve the right to modify these terms at any time. Users will be notified of significant changes through the app or email. Continued use of our services constitutes acceptance of the updated terms.
